Participant Waiver, Release of Liability & Assumption of Risk

Choose Your Own Adventure Drive & Car Show

By registering for and participating in the HBFirst Initiatives Choose Your Own Adventure Drive & Car Show ("the Event"), I acknowledge and agree to the following:

Assumption of Risk

I understand that participation in the Event, including driving, riding as a passenger, attending gathering locations, and participating in any related activities, involves inherent risks, including but not limited to motor vehicle accidents, road hazards, weather conditions, mechanical failure, property damage, personal injury, illness, or death.

I voluntarily choose to participate and assume all risks associated with my participation.

Release of Liability

In consideration of being permitted to participate in the Event, I hereby release, waive, discharge, and hold harmless:

HBFirst Initiatives;

All event organizers;

Event volunteers;

Event sponsors and partners;

Participating venues and property owners;

Municipalities and public authorities where applicable;

Event staff, contractors, agents, directors, officers, and representatives;

from any and all claims, demands, actions, causes of action, damages, losses, costs, or expenses arising from or related to my participation in the Event, including claims arising from negligence to the fullest extent permitted by the laws of Ontario.

Vehicle Responsibility

If I am operating a motor vehicle during the Event, I certify that:

I possess a valid driver's licence appropriate for the vehicle being operated.

The vehicle is properly registered and roadworthy.

The vehicle carries valid automobile insurance as required by the Province of Ontario.

I will comply with all applicable traffic laws, speed limits, and regulations.

I understand that this is not a race, rally, timed event, or competition.

I am solely responsible for the operation of my vehicle and any passengers travelling with me.

Passenger Responsibility

If I am attending as a passenger, I acknowledge that I voluntarily assume the risks associated with travelling in a privately owned vehicle and release the parties listed above from liability to the fullest extent permitted by law.

Conduct

I agree to conduct myself in a safe and respectful manner throughout the Event. Event organizers reserve the right to remove any participant whose behaviour is deemed unsafe, reckless, unlawful, or disruptive without refund.

Pets

Participants who choose to bring a pet to the Event do so entirely at their own risk.

I acknowledge and agree that:

I am solely responsible for the care, supervision, behaviour, and control of my pet at all times.

My pet must remain appropriately restrained, whether by leash, harness, carrier, or safely secured within my vehicle, as appropriate.

I am responsible for ensuring my pet does not create a safety risk, nuisance, or disturbance to other participants, volunteers, spectators, venue staff, or wildlife.

I accept full responsibility for any injury, damage, loss, or claim arising from the actions or behaviour of my pet, including injury to persons, damage to property, or interactions with other animals.

I release and hold harmless HBFirst Initiatives, its directors, officers, volunteers, sponsors, partners, participating venues, property owners, and all other released parties from any liability arising from my decision to bring a pet to the Event.

Event organizers reserve the right to require that a participant remove a pet from the Event if, in the opinion of organizers, the pet presents a safety concern or is causing disruption.

Junior Driver Experience

Participation in the Niagara Mini Rides Junior Driver Experience is voluntary. A parent or legal guardian must supervise participating children at all times and ensure they follow all instructions provided by Niagara Mini Rides staff. Children must meet the posted age and weight requirements to participate. By participating, parents/guardians acknowledge the inherent risks associated with children’s ride-on vehicle activities and release Niagara Mini Rides, Titus Partners Inc., the event organizers, sponsors, venue, and property owner from liability to the fullest extent permitted by law, except in cases of gross negligence or willful misconduct. Niagara Mini Rides reserves the right to refuse or remove any participant whose behaviour is unsafe or who does not meet participation requirements.

Medical Emergency

Should I require medical attention during the Event, I authorize emergency medical personnel to provide treatment deemed necessary. I understand that I am responsible for any associated medical expenses.

Photography & Media

I grant HBFirst Initiatives permission to photograph, video record, and otherwise capture my likeness, vehicle, and participation during the Event for promotional, marketing, fundraising, and social media purposes without compensation.

Indemnification

I agree to indemnify and hold harmless HBFirst Initiatives and all released parties from any claims brought by me, my passengers, family members, heirs, or representatives arising from my participation in the Event.

Acknowledgement

I acknowledge that:

I have carefully read this Waiver and Release of Liability.

I fully understand its contents.

I understand that I am giving up certain legal rights by agreeing to it.

I am at least 18 years of age or am registering with the consent of my parent or legal guardian.

I voluntarily agree to these terms.

By selecting "I Agree" during registration, I acknowledge that this electronic agreement has the same legal effect as my handwritten signature.

Changes to Terms
We may update these Terms at any time. Continued use of our services indicates acceptance of the revised terms.
